Estate Planning and Wills
From the simplest of wills to the most sophisticated of trusts, our attorneys bring a depth and breadth of experience to the challenges facing our clients. We spend the time to get to know our clients and their needs. Where appropriate, we work with our client’s other professionals including accountants and financial planners to create a customized comprehensive estate plan. We have experience in the creation of charitable foundations, charitable remainder trusts, charitable lead trusts and donor advised funds. We also have experience with planning for oil and gas rights and property transfers.
Once our client is ready, we will draft the documents necessary to implement an estate plan. We recognize that our clients’ needs change over their lifetime. Consequently, we view estate planning as an on-going relationship, and stand ready to make adjustments to the plan as appropriate.
Transfer of Family-Owned Businesses
One of the greatest challenges facing a family business is the transfer of ownership from one generation to the next. Our attorneys work with attorneys in our corporate department to develop appropriate transition plans that minimize regulatory and tax implications and maximize continuity of the business. We know that long term strategic plans for transition of the management and assets of a business are the best way to maximize the chances a family business will continue to operate for generations to come. In recent years, oil and gas investment properties have become a new type of family business for many in our region.
Elder Law and Lifetime Planning
Life constantly brings new challenges, and our attorneys are ready to assist our clients in meeting them. In addition to estate work, our attorneys are experienced in guardianship/conservatorship matters, including where necessary litigation. We assist clients in planning to maximize public benefits such as Medicare, Medicaid and Social Security, and in deciding when and how to withdraw from benefit plans, we are knowledgeable about taxation of distributions from employee benefit plans, including pensions, annuities, IRAs and Keoughs and health and long-term care planning. We draft health care proxies, advance directives, and powers of attorney. We can assist with the creation of trusts for minor children and grandchildren, and advise on planning for the continuing support of disabled children or other dependents.
Our relationship with our clients and their families continues during estate administration. We will meet with the family to explain the estate’s provisions to them and other beneficiaries. We arrange for the valuation and collection of assets and the payment of debts. Our services have also included the sale of closely held businesses, negotiations with beneficiaries and fiduciaries, and representation in contested probate proceedings.
