Banking & Financial Services
Our clients benefit from our continuous work with bank regulators, including the Federal Deposit Insurance Corporation, the Office of the Comptroller of the Currency, the Board of Governors of the Federal Reserve System, the National Credit Union Administration, the New York Department of Financial Services and the United States Department of Housing and Urban Development.
Business, Corporate, & Securities Law
Our Business, Corporate and Securities Law attorneys have structured, negotiated, and closed numerous acquisitions and divestitures through outright stock or asset sales, mergers, leveraged buyouts and strategic alliances. Often these transactions involve complex and multi-disciplinary legal issues such as taxation, intellectual property, environmental law, real estate law, labor and employee benefit law, and other similar issues. Our Corporate and Securities team works side-by-side with other attorneys within our firm who specialize in these areas to achieve the best results for our clients.
Commercial & Residential Real Estate
Real Estate Law has been a core practice area at Hinman, Howard & Kattell since the firm’s founding over a century ago, and remains one of the firm’s largest departments. With offices throughout New York, Pennsylvania, Florida, and New Jersey, Hinman, Howard & Kattell is able to offer clients local convenience combined with the skills of a large firm.
We are also experienced in construction litigation, mediation and alternative dispute resolution. Typical construction disputes that our Construction Law Practice Group handles involve: non-conforming or defective work, extra work or change orders, delays and accelerated work schedules, site condition discrepancies, wrongful termination, and liquidated damages.
The attorneys in our Criminal Defense practice group, a number of whom are former prosecutors, represent clients through all stages of a criminal case, from investigation to arrest, from a bail hearing to trial. We provide comprehensive criminal defense services both at the state and federal level in New York and Pennsylvania. The scope of our practice includes defending clients against a wide range of violations, misdemeanors, and felony charges.
Properly securing internal networks and sensitive data is among the most difficult challenges that modern businesses face. A data breach can compromise customers’ financial and personal data, damaging the customer relationships upon which business success is founded. Data breaches also compromise proprietary information, such as trade secrets, that businesses use to gain and maintain advantages in the market.
Elder Law & Guardianships
In addition to estate work, Hinman, Howard & Kattell’s attorneys are experienced in guardianship/conservatorship matters, including, where necessary, litigation. Our attorneys assist clients with decisions in planning to maximize public benefits such as Medicare, Medicaid and Social Security, and in deciding when and how to withdraw from benefit plans. We are knowledgeable about taxation of distributions from employee benefit plans, including pensions, annuities, IRAs and Keoughs and health and long-term care planning. We also draft health care proxies, advance directives, and powers of attorney. HH&K can assist with the creation of trusts for minor children and grandchildren, and also advise on planning for the continuing support of disabled children or other dependents.
Energy & Environmental Law
Hinman, Howard & Kattell monitors new developments and emerging issues in the complex realm of energy and environmental law, both at the state and federal level. We maintain good working relationships with environmental consultants and engineers, fellow environmental attorneys, and with government officials and agencies responsible for environment, health, and safety regulation and enforcement. These relationships enable us to assist clients efficiently and effectively in responding to energy and environmental legal issues as they arise. We also proactively follow and offer feedback on proposed new regulations and legislation that may positively or negatively affect our clients.
Health care is one of our nation’s most heavily regulated and volatile industries. Hinman, Howard & Kattell’s Health Law practice group actively monitors changes in the law and is able to navigate complex regulatory requirements as they emerge. In addition to keeping abreast of current trends in the field, HH&K’s attorneys possess a sound understanding of how health care is rendered, and the operational and structural issues affecting providers and payers.
In response to the growing demands of our corporate clients, Hinman, Howard & Kattell has developed the specialty practice areas necessary to enable complete and effective representation in virtually all aspects of business. Our Intellectual Property (IP) practice represents a broad variety of industries, with clients ranging from large corporations to individual inventors.
Labor & Employment
The workplace is always providing new challenges for employers, and the attorneys of Hinman, Howard & Kattell are here to assist in meeting them. Our attorneys are frequent lecturers in labor and employment topics to the local Chambers of Commerce, Bar Associations, and other community groups. We provide up-to-date, practical advice both for unionized and non-unionized employers. We believe in an individualized approach to meet our clients’ needs, rather than insisting on a “one-size-fits-all” solution.
